Course Objectives In the scope of this course; it is intended to be taught • In Citizenship Law: - The ways of acquisition, loss and proof of Turkish nationality. - The rights and obligations of having Turkish nationality. • In Foreigners and International Protection Law: - The statutes of foreigners - Foreigners rights and obligations - The scope of international protection - The administrative organisation of international protection. • In Conflict of Laws: - the law applicable to private law transactions and relations that contain a foreign element • In International Procedural Law: - The international jurisdiction of the Turkish courts - The recognition and enforcement of foreign judgments.
Course Content The subtitles of this course are; • “Law of Nationality”, the acquisition, loss and proof of Turkish nationality, • “Status of Aliens”, the rights of obligations of aliens in Turkey as distinct from those of Turkish nationals(i.e. fundamental rights for aliens, for ex. Right of entry, right of residence, right of employement, title to property, succession etc. • “Conflict Of Laws”, the law governing the relationships and legal acts involving foreign element, • “Law of International Civil Procedure”, the rules and procedure to be followed in cases involving foreign element in particular international jurisdiction of Turkish courts, recognition and enforcement of foreign judgments and arbitral awards, sovereign immunitiy, caution, prorogation, lis alibi pendens etc.
Learning Outcomes (LO) It is aimed for the students who will succesfully complete the course - To gain an distictive ability analyzing the subjects related to private international law - To follow the legislative changes - To learn the international fundemantal documents and follow the legislative changes - To have an idea about the professional practise by the practical lessons - To gain a vision about the comparative law matters related to the subjects of the course
